End User License Agreement (EULA)

Subject to your compliance with this EULA, BuildSkill Academy grants you a non-exclusive, non-transferable, revocable, limited license to:

• Download, install, and use the Software on your personal device(s).
• Access and view the Content for your personal, educational, and non-commercial purposes.
• Download course materials for offline viewing (where permitted by the course settings).

This license is granted solely for your personal learning and development. Commercial use is strictly prohibited.

3. License Restrictions

You may not under any circumstances:

• Copy, modify, adapt, translate, or create derivative works from the Software or Content.
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Software.
• Rent, lease, sublicense, distribute, or transfer the Software to any third party.
• Use the Software or Content for any commercial purpose without explicit written permission.
• Share your account credentials with others or allow unauthorized users to access the Platform.
• Use automated systems (bots, scrapers, etc.) to extract data from the Platform.
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices.
• Use the Software to upload, store, or distribute harmful, illegal, or offensive content.

4. Ownership & Intellectual Property

• Software: The Software is owned by BuildSkill Academy Private Limited and is protected by copyright, trademark, and other intellectual property laws.
• Content: All course content, videos, materials, and resources are the property of BuildSkill Academy or its licensors and are protected by copyright laws.
• Certificates: Digital certificates are provided for personal use only and may not be modified, reproduced, or used commercially without authorization.
• Branding: All trademarks, service marks, and trade names belong to BuildSkill Academy. You may not use them without prior written consent.

This EULA does not transfer any ownership rights. You acknowledge that the Software and Content are licensed, not sold, to you.

5. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials (MPIN, password, etc.).
• You are fully responsible for all activities that occur under your account.
• You must provide accurate and complete registration information.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate this EULA.

• Access to course content is granted upon successful enrollment and payment.
• You have lifetime access to purchased courses (subject to course availability on the Platform).
• Course content is for personal, non-commercial use only.
• You may not share, sell, or redistribute any course content or materials.
• Certificates of completion are provided for personal and professional use but do not guarantee employment or specific outcomes.
• We reserve the right to update, modify, or remove content at any time.

8. Termination

This EULA is effective from the date you first use the Software or Platform. It may be terminated:

• By You: You may terminate this agreement by uninstalling the Software and deleting your account.
• By Us: We may terminate this agreement immediately if you violate any terms of this EULA.
• Automatic: If you breach any material term, your license will automatically terminate without notice.

Upon termination, you must cease all use of the Software and Content, uninstall the Software, and destroy any copies in your possession.

9. Disclaimer of Warranties

The Software and Content are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Warranties that the Software will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy, completeness, or reliability of the Content.
• Warranties that the Software will meet your specific requirements or expectations.

Use of the Software and Content is at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, BuildSkill Academy Private Limited, its directors, employees, partners, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, or business opportunities.
• Damages arising from the use or inability to use the Software or Content.
• Damages caused by viruses, malware, or other harmful components.
• Damages arising from unauthorized access to your account or data.

In no event shall our total liability exceed the total amount paid by you to us for the specific course or service giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless BuildSkill Academy and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of:

• Your violation of this EULA.
• Your use of the Software or Content.
• Your infringement of any third-party rights.
• Your negligent or wrongful conduct.

• Your use of the Software is subject to our Privacy Policy.
• We collect, store, and process your data as described in our Privacy Policy.
• You consent to the collection and use of your data for providing and improving our services.
• We implement reasonable security measures to protect your data.

13. Governing Law & Dispute Resolution

• This EULA shall be governed by and construed in accordance with the laws of India.
• Any disputes arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
• We encourage you to first contact us to resolve any issues informally before pursuing legal action.

14. Changes to This EULA

We may update this EULA from time to time. We will notify you of any significant changes by:

• Posting the updated EULA on this page with a revised "Last updated" date.
• Sending an email notification to registered users.
• Displaying a notice within the Software or Platform.

Your continued use of the Software or Platform after any changes constitutes your acceptance of the new EULA.

15. Complete Agreement

This EULA constitutes the entire agreement between you and BuildSkill Academy regarding the Software and Content and supersedes all prior or contemporaneous communications, representations, or agreements, whether written or oral.
